How the Proceeds Split

When a case wins or settles, proceeds are distributed after attorney fees and court costs. Here's exactly where every dollar goes.

60% Plaintiff

The person who fought the case keeps the majority of every recovery. You earned it.

32% Investors

Distributed proportionally across all investors based on their contribution to the case fund.

8% Platform

Fund the Suit success fee — only taken if the case wins. Plus 4% of the initial raise upfront.

All percentages calculated on Net Proceeds — gross settlement minus attorney fees, court costs, and outstanding liens. If the case does not win, investors receive nothing and the plaintiff owes nothing.

Frequently Asked Questions

Is this legal?
Yes. Fund the Suit operates under Regulation CF (Reg CF), which allows companies to raise up to $5M per year from retail investors through a licensed funding portal. Each case offering is a registered securities offering. We are fully compliant with SEC and FINRA requirements.
What types of cases qualify?
Personal injury, wrongful termination, employment discrimination, breach of contract, fraud, and civil rights cases. Cases must have a clear legal basis, an engaged attorney, and a realistic path to recovery. We do not fund criminal defense cases.
What if the case loses?
Investors lose their investment. The plaintiff owes nothing — Fund the Suit uses a non-recourse model. The plaintiff is never personally liable to repay investors if the case is unsuccessful. That risk sits entirely with the investors.
Does Fund the Suit control my case?
Never. The plaintiff and their attorney retain full and exclusive control over all litigation decisions, including whether to settle and for how much. Fund the Suit and investors have zero ability to direct or influence legal strategy.
How much can I invest per case?
Investment limits are set by the SEC based on your annual income and net worth. Most investors can invest up to $2,500–$5,000 per case. Higher limits apply for accredited investors. You can invest across multiple cases simultaneously.
When do investors get paid?
Proceeds are distributed within 30 days of settlement or judgment becoming final and funds being received from the defendant. The timeline from investment to payout varies by case — typically 12–36 months depending on complexity.
What is the 4% upfront platform fee?
When a case is fully funded, Fund the Suit takes 4% of the total amount raised as a platform fee. This covers due diligence, case management, and platform operations. The remaining 96% goes directly to the plaintiff's legal fund.
Is this available in my state?
Fund the Suit is available to US investors and plaintiffs in most states. We initially operate in Texas, California, Florida, and Wyoming. Some state-specific restrictions may apply. Contact us to confirm availability in your state.
